This Agreement is entered into by and between the Participant (“Participant”) and the workshop hosts: [Marco Minetti and Douglas Black] (“Host”), sole proprietors, for participation in an in-person ceramics workshop.
The Participant acknowledges that participation in a ceramics workshop involves certain inherent risks, including but not limited to the use of sharp tools, exposure to heat, smoke, fire (e.g., kilns), slippery surfaces, heavy lifting, dust inhalation, and contact with potentially hazardous materials (e.g., glazes, clays). The Participant voluntarily assumes all such risks, known and unknown, even if arising from the negligence of the Host or others.
In consideration of being permitted to participate in the ceramics workshop, the Participant hereby releases, waives, discharges, and holds harmless the Host, its owners, employees, volunteers, contractors, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever, including but not limited to claims of negligence, resulting in personal injury (including death), property damage, or other harm to the Participant arising out of or related to participation in the workshop or presence on the premises.
The Participant agrees to indemnify and hold harmless the Host from any and all claims, demands, actions, or damages, including reasonable attorney’s fees, resulting from the Participant’s conduct, acts, or omissions while participating in the workshop.
The Participant gives consent to receive any medical treatment deemed necessary in the event of injury, accident, or illness during the workshop. The Participant releases the Host from any liability arising out of or related to such treatment.
The Participant grants permission for the Host to take photographs and/or video taken during the workshop for promotional or marketing purposes. No compensation will be provided for such use. You may opt out of this by letting the hosts or participants know in person on the first day of the workshop.
The Participant certifies that:
They are at least 18 years old or accompanied by a parent/legal guardian.
They are physically and mentally fit to participate in the workshop.
They will follow all safety instructions and workshop rules provided by the Host
They understand that clay activities may stain or damage personal clothing or belongings and accept responsibility for any such damage.
This Agreement shall be governed by and construed under the laws of the State of California. If any portion is held to be invalid, the remainder shall remain in full force and effect. This Agreement is binding on the Participant and their heirs, assigns, and legal representatives.
By clicking the "I Agree to the Terms" checkbox during checkout, the Participant affirms that they have read, understood, and voluntarily agreed to all the terms and conditions contained in this Release of Liability and Terms of Agreement. The Participant agrees that checking the box constitutes a valid and legally binding electronic signature pursuant to the U.S. Electronic Signatures in Global and National Commerce (E-SIGN) Act and the California Uniform Electronic Transactions Act (UETA), and shall have the same force and effect as a handwritten signature.
